I've never come across this before, but I don't think it's illegal. You don't own the callsign, and you can't copyright it. (You CAN trademark the name of a company that incorporates it, though.)

The only real restriction is probably that he can't use it to go on the air.

My guess is that most businesses in that situation would either select the callsign of the ownet or a satisfied customer (as an implicit reference) or one that is unassigned. Since you just received your call recently, the business was probably doing the latter. A polite email or letter indicating that you now hold that call would probably be effective.
