That is correct, Smokey. The callsign in question has to be meet requirement for availability on the day it is applied for. There is one caveat to this rule regarding those who submit application for a callsign while awaiting cancellation of said call by the FCC as a result of the previous holder being SK. In this case, although the call is technically not available at the time of application once the app is acted upon some 18-20 days later the call will have met the initial availability requirements as the FCC uses the date of death as the cancellation date. Hopefully the applicant chooses a call whose previous holder's date of death / callsign cancellation date is greater than 2 years prior to the FCC application date.
